Your use of the Website/Platform, services and tools herein are governed by the following terms and conditions. If You transact on the Platform, you shall be subject to the policies that are applicable to the Platform for such transaction. By mere use of the Platform, you shall be contracting with MEET THE NEEDS Company and these terms and conditions including the policies constitute Your binding obligations, with MEET THE NEEDS Company.
For the purpose of these Terms of Use, wherever the context so requires “You” or “User” shall mean any natural or legal person who has agreed to become a buyer on the Platform by providing Registration Data while registering on the Platform as Registered User using the computer systems. MEET THE NEEDS Company allows the User to surf the Platform or making purchases without registering on the Platform.
The company reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice to the user. It is the responsibility of the user to review these Terms of Use periodically for updates / modifications. The continued use of the Platform following the amendments in terms will mean that the user has accepted and agreed to the amendments.
You shall independently agree upon the manner and terms and conditions of delivery, payment, insurance etc. with the seller(s) that you transact with.
Accessing, browsing or otherwise using the website or platform indicates your agreement to all the terms and conditions hereunder.
By impliedly or expressly accepting these Terms of Use, you accept and agree to be bound by the policies hereunder and as amended from time to time.
CONDITIONS OF USE
Eligibility of User:
Transaction(s) on the Platform is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are incompetent to contract within the meaning of the Indian Contract Act, 1872 are not eligible to use the Platform. The company reserves the right to terminate your membership and/or refuse to provide you with access to the Platform if it is brought to the company’s notice or if it is discovered that You are under the age of 18 years and transacting on the Platform.
User Account:
You hereby agree and acknowledge that if you use the MEET THE NEEDS Platform/Website, you shall be responsible for maintaining the confidentiality of your account and password and for preventing unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account. You should take all necessary steps to ensure that the password to your account is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner. Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. The company reserves the right to refuse access to the website/platform or terminate account(s) at any time without notice to you.
Privacy: The privacy policy of MEET THE NEEDS is no information is passed nor given to any companies, marketing or those outside MEET THE NEEDS. All information is only on the MEET THE NEEDS platform for the purposes of distributing product or for review written by clients. No addresses or personal information is for public distribution but it may be used for internal communication and marketing like push notifications, flash deals etc. If you wish to check privacy policies of our platform providers, please go to the GoDaddy website and AWS website for their privacy policies.
Conduct of User:
You must not use the website in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired in any way. You shall be responsible for all electronic communications sent from your computer to us and you must use the website for lawful purposes only.
Communication:
When you use the website/platform or send emails or other data, information or communication to us, you agree and understand that you are communicating with us through electronic records and you further agree to receive communications via e-mail and/or SMS on the registered mobile number from us periodically as and when required. We may communicate with you by email or by such other mode of communication, electronic or otherwise.
Conditions of Sale:
The website/platform can be utilized by users to reach a larger base to buy products.
This, MEET THE NEEDS, Company merely provides a platform for communication and it is agreed that the contract for sale of any of the products shall be a strictly bipartite contract between the Seller and the Buyer.
The company does not make any representation or warranty as to specifics such as quality, value etc. of the products proposed to be sold or offered to be sold or purchased on the website/platform.
The company does not implicitly or explicitly support or endorse the sale or purchase of any products or services on the website/platform.
The company accepts no liability for any errors or omissions, whether on behalf of itself or third parties.
Availability of Products:
We list the available products on our MEET THE NEEDS website/platform. Please note that dispatch estimates are merely estimates. They are not guaranteed dispatch time and should not be relied upon as such. As we process your order, you will be informed by e-mail or any other form of communication, electronic or otherwise, if any products you order turn out to be unavailable.
Pricing:
The price for the products are listed along with the products. All prices are inclusive of Taxes as applicable unless stated otherwise. You shall be responsible for payment of all delivery charges/fees/costs/charges associated with the purchase of products from us and you agree to bear any and all applicable taxes.
Payment:
While availing any of the payment method(s) available on the website/platform, we will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to you due to lack of authorization for any transaction(s) or exceeding the pre-set limit mutually agreed between you and the bank(s) or decline of transaction for any other reason(s).
All payments made against the purchases on website/platform by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. Website/platform will not facilitate transaction with respect to any other form of currency with respect to the purchases made on website/platform.
Return Policy:
Most products are returnable within the applicable return window subject to the conditions hereunder:
We will process a return only if we can determine that the product was not damaged while in your possession, product is not different from what we shipped to you and you return the product in its original condition with the MRP tag intact, brand’s/manufacturer’s box, user manual, warranty card and all the accessories therein.
In case of return of damaged perishable goods/products, you can return the same within a window of one hour from the time of delivery of goods so received. The refund for the same shall be made to the app wallet on behalf of the seller after deducting the pick-up charges.
Products may be eligible for replacement only if the same seller has the exact same product in stock.
If the replacement request is placed and the seller does not have the exact same product in stock, we will provide a refund to the app wallet on behalf of the seller after deducting the pick-up charges.
You cannot return products marked as “non-returnable” on the product detail page.
Cancellation Policy:
You can cancel your order for a product at no cost any time before we send the Dispatch Confirmation E-mail relating to product so ordered.
Amendments/Modifications to Policy & Conditions:
We reserve the right to make changes to our policies and these Conditions of Sale at any time. You will be subject to the policies and Conditions of Sale in force at the time you order goods from us.
Force Majeure:
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control.
Limitation of Liability:
In no event shall the company be held liable for any special, incidental, indirect or consequential damages of any kind in connection with these Terms & Conditions, even if user has been informed in advance of the possibility of such damages.
The company is not responsible for any non-performance or breach of any contract entered into between Buyers and Sellers.
The company cannot and does not guarantee that the concerned Buyers and/or Sellers will perform any transaction concluded on the website/platform.
The company shall not and is not required to mediate or resolve any dispute or disagreement between Buyers and Sellers.
Jurisdiction:
This Terms & Conditions shall be governed, interpreted and construed in accordance with the laws of India. Notwithstanding the foregoing, you agree and acknowledge that:
Any dispute or difference whatsoever arising between the company and user(s) out of or relating to the meaning, scope, operation or effect of this terms and conditions or the validity or the breach thereof shall be settled by arbitration.
The jurisdiction for the arbitration proceedings shall be Kollam, India.
The award made in pursuance thereof shall be binding on the company as well as the user(s).
The proceedings shall be as per the Arbitration and Conciliation (Amendment) Act, 2021.
